How to Prepare for a CCMA Hearing
Preparing for a CCMA hearing means collecting all necessary documents to prove your case, especially if you do not settle at conciliation stage. The commissioner does not make any judgements during the conciliation stage, but is gathering knowledge of the case to advise both parties on whether to settle or not, and how to do so. CCMA Procedure – Arbitration
Should conciliation fail, you may request the CCMA to resolve the dispute by arbitration. The commissioner will give both parties an opportunity to state their cases in detail. The commissioner will then decide on the issue presented. At an arbitration hearing the party in dispute may appear in person or be represented by a legal practitioner. Lawyers are not usually allowed to represent parties in arbitrations. Having heard both sides of the arguments, the commissioner will decide the outcome of the case by issuing an award. The decision made is legally binding on the parties and ends the dispute. Arbitration awards are sent to the parties within 14 days of the arbitration.
